# Terms and Conditions Welcome to Giggles Fashion. By using this site you agree to these terms. COMPLISOLAR (PTY) LTD t/a GIGGLES UNDERWEAR TERMS AND CONDITIONS OF SALE AND PRIVACY POLICY 1. ACCEPTANCE OF TERMS By placing an order through the Giggles Underwear website, the customer confirms that they have read, understood and agreed to these Terms and Conditions. 2. PRODUCTS 2.1. Giggles Underwear supplies period underwear designed for tweens and teens. 2.2. Product images, colours and descriptions are provided for illustrative purposes and may vary slightly from the actual product supplied. 3. ORDERS AND PAYMENT 3.1. All orders are subject to product availability. 3.2. Full payment must be received and cleared before any order is processed or dispatched. 3.3. No credit facilities are offered. 3.4. Ownership of the products shall remain vested in Complisolar (Pty) Ltd until full payment has been received. 4. DELIVERY 4.1. Delivery is undertaken through independent third-party courier services. 4.2. Delivery will generally be completed within seven (7) working days from confirmation of payment. 4.3. Delivery times are estimates only and are not guaranteed. 4.4. Complisolar (Pty) Ltd shall not be liable for delays, losses, theft, damage, non-delivery, incorrect delivery, or any claim arising from the acts or omissions of any courier, transport provider or other third party. 5. WARRANTY 5.1. Giggles Underwear products carry a limited warranty of twenty-four (24) months from the date of purchase. 5.2. Giggles Underwear is worn at the risk of the purchaser. 5.3. The warranty applies only where the product has been worn, used and washed strictly in accordance with the care instructions supplied with the product. The warranty does not apply to: 5.3.1. Normal wear and tear; 5.3.2. Misuse or abuse of the product; 5.3.3. Improper washing or care; 5.3.4. Alterations or modifications to the product; 5.3.5. Accidental damage. 6. RETURNS, REFUNDS AND REPLACEMENTS 6.1. Due to the intimate and hygienic nature of the products, no refunds will be granted. 6.2. Any queries relating to the return, refund or replacement shall be directed to the email address as per clause 14 of this document. 6.3. Replacement of a defective product shall be at the sole discretion of Complisolar (Pty) Ltd after inspection and verification of the alleged defect. 6.4. Proof of purchase must accompany all warranty claims. 6.5. The decision of Complisolar (Pty) Ltd regarding any replacement request shall be final. 7. LIMITATION OF LIABILITY 7.1. To the fullest extent permitted by law, Complisolar (Pty) Ltd, its directors, shareholders, employees, agents and contractors shall not be liable for any indirect, incidental, special, punitive or consequential damages arising from the purchase, use or inability to use any product. 7.2. The maximum liability of Complisolar (Pty) Ltd for any claim whatsoever shall be limited to the purchase price paid for the specific product giving rise to the claim. 7.3. Under no circumstances shall Complisolar (Pty) Ltd be liable for any third-party claim, loss of income, loss of profits, loss of opportunity, emotional distress, medical costs or any consequential loss. 7.4. Customers use the products at their own risk and are responsible for ensuring suitability for the intended user. 8. PRIVACY POLICY 8.1. Complisolar (Pty) Ltd respects and protects personal information in accordance with the Protection of Personal Information Act, 4 of 2013 ("POPIA"). 8.2. Personal information collected may include: 8.2.1. Full names; 8.2.2. Email addresses; 8.2.3. Telephone numbers; 8.2.4. Delivery addresses; 8.2.5. Billing information; 8.2.6. Order history; 8.2.7. Any other information voluntarily provided by the customer. 8.3. Personal information is collected solely for: 8.3.1. Processing and fulfilling orders; 8.3.2. Delivering products; 8.3.3. Customer support and communication; 8.3.4. Legal and regulatory compliance; 8.3.5. Marketing communications where consent has been provided. 8.4. Personal information may be shared with: 8.4.1. Payment service providers; 8.4.2. Courier and logistics providers; 8.4.3. Regulatory authorities where required by law. 8.5. By placing an order, the purchaser warrants that they are authorised to provide any personal information relating to a minor. 10. PAYMENT CARD INFORMATION 10.1. Credit and debit card payments are processed through secure third-party payment gateways. 10.2. Complisolar (Pty) Ltd does not store full card numbers, CVV numbers, PINs or online banking passwords. 10.3. Customers submit payment information through the payment provider's secure platform at their own risk. 11. ELECTRONIC COMMUNICATIONS 11.1. By using the website, the customer consents to receiving communications electronically. 11.2. Electronic communications, notices and records shall satisfy any legal requirement that such communications be in writing. 12. INTELLECTUAL PROPERTY 12.1. All website content, trademarks, logos, product designs, photographs and branding remain the property of Complisolar (Pty) Ltd or its licensors. 12.2. All information relating to the manufacturers and specification of the product remains the ownership of Complisolar (Pty) Ltd. 13. GOVERNING LAW 13.1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. 13.2. Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa. 14.
